Can we burn the American flag?

The short answer to this question is yes, you can legally burn the flag. Others might get mad at you and hurt you, but you are 100% allowed to burn the American flag. However, there have been amendments proposed to make it illegal to desecrate a flag in any way. The most recent one failed by one vote in 2006.

The reason that many people think that it should be a crime to burn or deface the flag in any way is that people view flag burning in protest as a way of dishonoring the U.S. or saying, "America must die." However, many other people view it as symbolizing that America needs to change or that it has strayed from the path envisioned by our founding fathers.

In order to get more opinions, I interviewed some kids at Peak to Peak. I got answers ranging from "People who burn flags should be jailed and given a cactus a day until they starve" to "They should be fined" along with answers like "Long live the King" and "No comment". The general consensus was that flag burners should be punished in some way.

On top of protest, flags are also burnt to retire them. This is different than burning flags for protest because it is honoring the flag. These ceremonies only occur when a flag is no longer fit to fly. They are more commonly performed in the military when a flag has been damaged. The flag is burnt in seperate pieces and at the end, everyone says "Our flag rests in peace."
